Two of the families of the men who lost their lives during the 2012 Benghazi terrorist attack filed a wrongful death lawsuit against Democrat presidential nominee Hillary Clinton earlier in the year, but it appeared as though Clinton has not seen fit to respond to that suit as required by law.
According to The Hill, Clinton was declared to be in default by the court on Friday after she neglected to answer the complaint in the appropriate time.
Clinton will now be compelled to respond to the lawsuit — either by arguing against it, moving to have it dismissed or requesting an extension — or ignore it and have the judge rule in favor of the plaintiffs by default.
The lawsuit was filed by attorney Larry Klayman on behalf of Patricia Smith and Charles Woods, the parents of Sean Smith and Tyrone Woods, who were killed in the Benghazi attack. The suit alleged that Clinton was responsible for their deaths due in large part to her mishandling of classified information on her private server, which could have aided the terrorists who plotted and carried out the 2012 attack.
“As a direct result of Defendant Clinton’s reckless handling of this classified, sensitive information, Islamic terrorists were able to obtain the whereabouts of Ambassador Christopher Stevens and thus the U.S. State Department and covert and other government operations in Benghazi, Libya, and subsequently orchestrate, plan and execute the now infamous Sept. 11, 2012, attack,” the suit reads.
Klayman stated that Clinton’s failure to respond to the lawsuit against her proved that she simply “doesn’t care about our clients.”
“Most private litigants would never have something go into default and it’s tantamount to her saying, ‘What difference does this lawsuit make?’” he explained.
The suit, which awaited action in the court of U.S. District Judge Royce Lamberth, was filed as a related case to the many other lawsuits seeking access to Clinton’s federal records while she served as secretary of state. It sought unspecified damages and a jury trial over Clinton’s presumed culpability for the Benghazi attack.
For its part, the Clinton campaign essentially dismissed the merit of the suit by pointing to the numerous investigations that have already delved into the Benghazi debacle without finding Clinton guilty of wrongdoing, though its did offer sympathy to the families of the four fallen Americans.
It will be interesting to see how Clinton eventually responds to the lawsuit, which her campaign was likely hoping would simply go away if they ignored it.
Now that she has been found in default and a response is required to keep the case from being automatically decided against her, it’ll be a little harder for her to ignore.
A decent lawyer probably could have predicted that.
